HistoryPOAVA, Inc. was established in 1981 to provide attention to and strengthen POAs beyond those originally mandated in certain subdivisions by the Subdivided Land Sales Act (SDLSA). This was the first law in Virginia to provide credibility to property owner associations on a limited application basis. In ensuing years, POAVA promoted POAs and made a number of attempts to improve legislative recognition of amendments to the SDLSA and the study of separate comprehensive regulations. This led to a report issued by the Board of Commerce in 1987 indicating that the management aspects of the SDLSA and the Non-Stock Corporation Act were inadequate and new regulation was needed. The Virginia Property Owners' Association Act (VPOAA) passed in 1989 was the end result. POAVA continues to be active in monitoring and providing input into this Act and it amendments. In carrying out other aspects of it charter, POAVA has provided educational assistance and promoted exchange of information on a variety of subjects, including:
POAVA IS UNIQUE The operation and make-up of POAVA is unique in several respects. It devotes its attention to residential planned communitites rather than condominiums, timeshares, cooperatives or campgrounds. Its membership consists of communities established in rural areas in the 60's, 70's, and 80's primarily for recreations and retirement purposes. Thus their operational and management problems (including those involving Article of Incorporation, Restrictions, Covenants, Rules and Regulations, Bylaws, Assessments, Membership Requirements and Occupancy of Lots), often vary significantly. Another area of uniqueness involves manpower and funding to manage and operate association efforts. Some POAVA members have limited funding and operate primarily on a volunteer basis with few if any paid employees to provide maintenance and support, others have a large annual budget and large support staff. Thus there is a continued need for re-education in which POAVA can be most helpful on a grass roots basis. In this respect, one of the major strengths of POAVA is that its membership consists of a mixture of large and small POAs. This enables a broad and free sharing of ideas between these POAs on an eyeball to eyeball basis expecially at membership meetings. |
